FAQ: Is a local driver required to use the ELD if the vehicle is equipped with one?

In the scenario where a vehicle is equipped with an ELD and is being operated by a driver who is not subject to ELD regulations, are they required to electronically record their hours?

According to the technical standards on the CCMTA website:

3.1.3 Configuration of an exempted driver account for ELD usage

As specified in provision 4.3.3.1.2 of this standard, the carrier must be able to configure an ELD for a driver who is exempt from ELD usage. For example, an exempted driver may be one benefiting from the exemption for short-haul drivers under the current hours of service (HOS) regulation (within a 160 km radius of the home terminal). Even though exempted drivers are not required to use an ELD, when a CMV is equipped with an ELD that is used by both exempted and non-exempted drivers, carriers can utilize this configuration to avoid issues stemming from diagnostic errors for data not associated with a specific driver.
